Edgardo Barreto-Pagán is a Member in the Labor and Employment Division of Fiddler, González & Rodríguez, P.S.C.
Mr. Barreto’s areas of practices are employee benefits and executive compensation counseling. Mr. Barreto advises clients in the design and administration of total compensation programs to meet corporate goals and assure compliance with applicable laws and regulations.
His counseling practice includes design of employee welfare benefit and pension benefit plans; preparation and review of plan documents, summary plan descriptions, summary of material modifications, and all types of participant disclosures; Qualified Domestic Relations Orders (QDRO’s) handling and counseling; Qualified Child Medical Support Orders (QCMSO’s) handling and counseling; preparation and review of Government reporting including Form 5500 and 480.70(OE); preparation and review of non-discrimination testing; HIPAA privacy policies and procedures, COBRA policies and notifications; executive compensation plans design and counseling, and assisting with third party audits. He also assists boards of directors by drafting corporate resolutions related to plan adoptions, amendments and terminations. He has ample experience in handling employee benefit plans in corporate spin-offs and mergers and acquisitions.
Mr. Barreto’s practice also includes representation of employers/plan sponsors before the U.S. Department of Labor, Employee Benefit Security Administration, Pension Benefit Guaranty Corporation, Internal Revenue Service and Puerto Rico Treasury Department. He assists plan sponsors with request of private rulings and determination letters, plan audits, plan examinations, Delinquent Filer Voluntary Compliance (DFVC) program, and Voluntary Fiduciary Compliance (VFC) program.
In his practice, Mr. Barreto represents local and global corporations in the following lines of industries: telecommunications, banking and finance, pharmaceuticals manufacturing and distributions, health care, food and spirits, insurance, construction, security, military manufacturing, aviation, and electronics.
He frequently serves as speaker in seminars on Employee Benefits Law with the Puerto Rico Manufacturers Association, the Puerto Rico Chamber of Commerce, as well as for many clients of Fiddler.
