THE PUERTO RICO ENERGY COMMISSION PUBLISHES PROCEDURAL REGULATIONS
On December 30, 2014, the Puerto Rico Energy Commission (the “Commission”) issued a public notice notifying the general public of the approval, and availability for public comment of the Regulation on Adjudicative Procedures, Notices of Noncompliance, Rate Review Procedures and Investigations (the “Regulation”). The Regulation became effective on December 18, 2014, after its approval by the Commission as an emergency regulation.
The Regulation establishes the rules that will apply to the adjudicative procedures carried out before the Commission, including those related with electric service rate reviews and approval, noncompliance notices, and procedures governing investigations. The rules also cover matters such as standing, affirmative defenses, discovery procedures, public hearings, penalties, investigations and inspections.
Although already in effect, pursuant to the provisions of the Puerto Rico Administrative Procedure Act, the Commission will allow comments from interested parties on the Regulation until January 29, 2015.
